A Blood Alcohol Content of .08% is the "per se" limit; it is automatically illegal to drive at or above this level of intoxication, regardless of observed impairment.

Driving at or above this level is a criminal offense and can result in arrest, vehicle impoundment, license suspension, and potentially jail time and fines.
